On February 16th violence broke out at the Ashram of Anand Krishna in Ubud. The South Jakarta District Attorney Office tried to arrest Anand Krishna by force and and they employed a sizeable number of uniformed men.

Those men, who were supposed to be policemen, violently flung and smacked Anand Krishna’s sympathizers down, the people who formed a human barricade, who were trying to stop and prevent any attempt to arrest Anand Krishna.

The family members of Anand Krishna regretted the arrest of this interfaith spiritual figure. They deemed it a form of abuse of power perpetrated by the Attorney Office. They requested President Susilo Bambang Yudhoyono to intervene on this matter.

Because of this execution of the arrest warrant by force carried out by a joint team of the District Attorney Office and Police on Saturday February 16th, 2013 at Anand Ashram in Ubud, Bali, Anand Krishna’s party will take this case to the President.

“We are going to report this arrest by force to President SBY through Presidential Advisory Council and the Police Headquarters. The Supreme Court’s decision is legally null and void since it does not comply with the law,” Prashant Gangtani, the son of Anand Krishna confirmed.

Prashant added, “The arrest on Saturday was an abuse of power committed by the South Jakarta District Court. To continue executing a decision that is unlawful is the same as taking away somebody’s freedom. Here we requested SBY to reprimand his aide, which is the Attorney Office.”

Other than reporting this to the President, Prashant is also going to report this arrest by force to National Commission on Human Rights and Indonesian Police Headquarters.

“We want the Police to intervene and immediately arrest Mashyudi as the Head of South Jakarta District Attorney Office for the allegation of violating article 333 of the Indonesian Criminal Code about taking away somebody’s freedom,” he explained.

Mashyudi gave the order to his subordinates to conduct this arrest by force. Mashyudi should know that the Supreme Court’s decision is unlawful because it does not fulfil all the requirements as stipulated by article 197 of Criminal Code Procedure.

“He simply ignored the law and continued to misuse his power, therefore, we fear that there will be other victims who will also lose their freedom,” Prashant said, full of regret.

As many people already know, on November 22nd, 2012 the Constitutional Court already confirmed that in order to criminalize someone, article 197 paragraph 1 must be fulfiled.

Even Commission III People’s Representative Assembly already asked the High Attorney Office specifically to implement the decision of the Constitutional Court. This is done in order to uphold justice and the rules of law.

Prashant added, the Attorney Office has committed abuse of power many times in the case of Anand Krishna. “According to Criminal Code Procedure an acquittal cannot be appealed, it’s a legal violation that the Prosecutor Martha Berliana Tobing committed. And the Supreme Court also granted the appeal and made a decision to overturn the acquittal, although it does not comply with article 197 so it’s declared legally null and void. Yet it didn’t stop them from executing the arrest warrant,” Prashant concluded.

Anand Krishna Supporters Complain About Guru’s Arrest

Family and supporters of spiritual guru and convicted sex offender Anand Krishna will file a report with President Susilo Bambang Yudhoyono to complain about his arrest over the weekend by the South Jakarta district attorney’s office, calling it an abuse of power and unlawful.

“We will ask the president to remind his subordinates, in this case the prosecutors, not to break the law and to release my father,” Prashant Gangtani, one of Anand’s sons, said on Sunday.

Anand was acquitted by the South Jakarta District Court in November 2011 of his sexual harassment charges brought by three of his female students, but prosecutors filed an appeal and the Supreme Court overturned the decision last August, handing him a two-and-a-half-year jail term.

However, Anand defied three straight summonses from the South Jakarta district attorney’s office to turn himself in to serve his sentence, prompting prosecutors to move to arrest him on Saturday.

However, Prashant said prosecutors had violated protocol by appealing against Anand’s acquittal by the district court. He argued this made the Supreme Court’s ruling against his father a violation.

He added that his family and Anand’s supporters had also reported the prosecutors to the police for what they termed the illegal detention of the spiritual guru.

Several activists have voiced their support for Anand, with the National Commission for Human Rights (Komnas HAM) saying the Supreme Court’s verdict was unlawful and a violation of human rights.

The Attorney General’s Office, however, has insisted that with the court agreeing to hear the prosecutors’ appeal and handing down a ruling, there was no reason not to detain Anand.

Setia Untung Arimuladi, a spokesman for the AGO, said on Saturday that Anand, who was arrested in his house in Ubud, Bali, would be taken to Cipinang Penitentiary in East Jakarta to serve his sentence.

Setia said that when the team from the prosecutors’ office and around 50 Bali police officers went to arrest Anand, his followers from the Anand Ashram Lovers Community tried to prevent them from taking him.

“Inside [his house], around 50 followers from the Anand Ashram Lovers Community led by Anand’s son, Prashant, were waiting,” Setia said.

“There were arguments because they did not want him [Anand] to be taken.”

Police managed to take Anand into custody after a religious leader from Ubud stepped in to end the standoff.

Destroyer and deliverer: The true meaning of Vishnu s Kalki avatar

Editor’s Note:  In the divine trinity of Brahma, Vishnu and Shiva, Vishnu is commonly called the Preserver  while Shiva is  the Destroyer. Alternatively Vishnu is the householder, worshipped with sprigs of tulsi, a household plant, while Shiva is the hermit, worshipped with  leaves of bilva, grown outside the house. But in Vishnu’s last avatar, Kalki, he appears to take on the form of  the destroyer as well. However the avatar of Kalki is really about letting go with faith in renewal, writes mythologist Devdutt Pattanaik in his new book 7 Secrets of Vishnu (Westland Ltd.). Here is an excerpt.

Kalki is the tenth and final avatar of Vishnu, visualised as a warrior who rides a white horse and brandishes a flaming sword.

The story of Kalki starts appearing in Hindu scriptures at the time when India was overrun by a whole host of foreign marauders from Central Asia. These were brutal and barbaric tribes such as the Huns and later the Mongols. The story was a clear response to their brutality. These new invaders were destroying the old way of life and it was hoped that Vishnu, as Kalki, would destroy the new ways, and restore life to the old ways. Kalki was probably inspired by messianic thoughts that are prevalent in Judaism, Christianity and Islam. He was the deliverer and the saviour.

Across India, there are many folk heroes who ride a horse and brandish a sword much like Kalki. He is thus almost a guardian god in folk imagination. But in the scriptures, he is the one who will close the Kalpa, the world-cycle, so that a new one can begin.

Even the Buddhists had a similar idea, of a Bodhisattva of the future, Manjushri, who yields a flaming sword. In the Tibetan Buddhist tradition, this wrathful manifestation Manjushri is called Yamantaka. Yamantaka is an epithet associated with Shiva in Hindu tradition and means the destroyer of death. Thus, metaphysically, Kalki will destroy everything, even death. He will destroy all structures so that none exist. In other words, he will herald Pralaya.

Material reality is impermanent. It has to change; in other words, it has to die and be reborn. So everything that has form and name has to eventually wither away and die. In the lore of Vishnu these transformations of Prakriti are not random; they are organised and predictable. They take the form of yugas, or eras.

Just as every living organism goes through four phases of life — childhood, youth, maturity and old age — so does the world. Krita yuga marks the childhood of the world, Treta yuga marks the youth, Dvapara marks the maturity of the world and Treta, its old age. Parashurama heralds the end of Krita, Ram the end of Treta, Krishna the end of Dvapara, and Kalki marks the end of Kali yuga. Pralaya is death, death before rebirth. Pralaya is when Vishnu goes to sleep, becomes Narayana. Pralaya is when Ananta becomes Sesha, infinity becomes zero and Yoga-maya becomes Yoga-nidra.

Vishnu thus acknowledges the end of the world, engages with it, even participates in it. While as Parashurama and Ram and Krishna, he struggles to hold on to dharma, despite the corrupting march of time, as Balarama and finally Kalki, he lets go and allows the world to collapse. This is wisdom, knowing when to act and when to withdraw, knowing when to stop fighting and allowing age to take its toll.

The beginning of the end

The idea of things ending recurs in the three great epics of India: Ramayana, Mahabharata and Bhagavata. In the Ramayana, in the end, Sita returns to the earth whence she came from and Ram walks into the river Sarayu, never to rise up again. In the Mahabharata, in the end, the Pandavas have to renounce their kingdom and walk up the mountains, seeking heaven and ultimately facing death. In the Bhagavata, Krishna leaves the village of cowherds, Vrindavan, and makes his way to the city of Mathura. He leaves on a chariot whose charioteer’s name is Akrura, one who is not cruel. The milkmaids beg Krishna to stay back but Krishna moves on to the next phase of his life, abandoning his parents and friends and lovers. That the charioteer is ‘not-cruel’, is a clear communication that one must never begrudge the march of time. Like Yashoda, who raised Krishna with love and affection only to watch him leave her and go to Mathura, we must all ultimately learn to let go.

In a way, Akrura is Yama, the god of death, described in mythology as dispassionate. Yama evokes fear in all of us. But Yama himself does not seek to frighten; he has no feelings. He is merely doing his duty as the one who separates material reality from spiritual reality. The journey which begins in the mother’s womb ends with the arrival of Yama. In the mother’s womb, thanks to Kama, the god of love, spiritual reality interacts with and is wrapped in material reality. But a time comes when Yama must unwrap the material reality and release spiritual reality.

Both Kama and Yama are forms of Vishnu, doing their duty, preserving the cycle of rebirths. Kama ignites life. Yama ignites death. Kama ensures death is not permanent; Yama ensures life is not permanent. There are typically no temples dedicated to Kama or Yama but their images are sometimes seen in Vishnu temples. Kama is depicted riding a parrot and holding a sugarcane bow in his hand; Yama rides a buffalo and holds in his hand either a book of accounts or a staff or a noose. Kama arouses the senses, makes Brahma succumb to the power of Maya; Yama ensures that all actions are repaid, thus maintaining the account book of Karma.

The symbols of Kama and Yama are found on the image of Vishnu. Vishnu holds in his hands four symbols: Shankha (conch), Chakra (wheel), Gada (mace) and Padma (lotus). Shanka symbolizes communication; Chakra marks the wheel of time; Gada the demand for discipline; Padma the nectar of joy. Shankha and Padma are water symbols; they affirm life and love and so are associated with Kama. Chakra and Gada are fire symbols; they affirm the rhythm of nature and the rules of culture and so are associated with Yama. Together, Kama and Yama preserve life. Together, Kama and Yama make up Vishnu.

The fire-breathing mare

A little known character in Hindu mythology is Vadavagni, a mare which breathes fire and stands on the ocean floor. This submarine mare causes the sea water to evaporate and turn into mist, thus preventing the sea from ever overflowing on to land. It is said that at the time of Pralaya, Vadavagni will stop doing this, causing the ocean to expand and submerge the earth. The fire of the submarine mare will burst forth in the form of volcanoes. Everything will be destroyed by lava and water.

The origin of the fire-breathing mare is interesting. According to one story, Kama, the god of love, once tried to arouse desire in the mind of Shiva. Shiva opened his third eye, released a missile of fire and destroyed the god of desire. But without desire, the world cannot function. Hence, Vishnu caught the fire of Shiva’s third eye, turned it into a mare and hid her under the sea.

The horse is a highly revered animal in Hinduism right from Rig Vedic times even though, strangely, the horse is not a native Indian animal. It does not thrive in the subcontinent except in parts of Gujarat and Rajasthan. Since the horse came into India from the North West frontier, along with traders and marauders, Vishnu’s horse-riding form, Kalki, has been associated with warlords who overran India in medieval times.

Vishnu not only rides a horse. He also becomes a horse. One form of Vishnu with the head of a horse that is highly revered especially in south India is Hayagriva. This form of Vishnu is associated with education. From the horse’s head emerges Saraswati, goddess of knowledge. Vedic mythology is full of tales where wisdom reaches the world through horse-headed beings. The sun, for example, appeared with a horse’s head to reveal the wisdom of the Veda to Rishi Yagnavalkya. Rishi Dadichi replaced his human head with a horse’s so that he could share Vedic wisdom with the Ashwini twins.

A matter of horse sense

What is this Vedic wisdom? Vedic wisdom is realisation that there is more to life than material reality that is perceived through the senses. It is wisdom that liberates us from the limitations of nature. It enables man to break free from Prakriti (material reality) and realize Purusha (spiritual reality). Prakriti makes us mortal and restless, Purusha makes us immortal and serene. The journey from Brahma to brahman, from the finite to the infinite, is the song of Hayagriva.

Hayagriva draws attention to the fact that the notion of property is not an objective reality, but a subjective truth, a cultural construction of human beings, not a natural phenomenon. In other words, they are creations of Maya and components of Brahmanda. If man does not exist, there would be no property to possess. Nature does not need man; man needs nature. It is a delusion of man that it is the master of nature, and the owner of nature’s wealth and information.

When we self-aggrandise ourselves by being territorial and dominating other human beings, Hayagriva reminds us that we are still animals, displaying animal instincts of survival, and that we have not evolved despite a larger human brain. Vedic wisdom is that which enables man to break free from the animal and discover the human. To break free from fear and discover faith. For that, we have to surrender to the idea of spiritual reality, to Purusha, that which exists beyond Prakriti.Image

Komisi III: Eksekusi Harus Berpedoman pada Pasal 197 KUHAP

Jakarta – Pasal 197 Kitab Undang-Undang Hukum Acara Pidana (KUHAP) harus menjadi pedoman jaksa dalam mengeksekusi terpidana. Hal itu diingatkan Komisi III DPR RI menyusul adanya putusan Mahkamah Agung (MA) yang batal demi hukum, namun tetap akan dieksekusi oleh jaksa.

“Supaya Jaksa Agung memperhatikan soal pelaksanaan putusan itu. Melaksanakan putusan melihat batas waktu berdasarkan pasal 197 KUHAP. Intinya, kita melakukan pengawasan, salah satunya pelaksanaan pasal 197 KUHAP,” tegas Wakil Ketua Komisi III, Tjatur Sapto Edy, usai Rapat Dengar Pendapat antara Kejagung RI dengan Komisi III di gedung DPR, Senin (11/6).

Tjatur yang bertindak sebagai pimpinan RDP, menegaskan, Komisi III DPR mengawasi langsung proses eksekusi. Atas dasar itu, ia mengingatkan jaksa agar mematuhi KUHAP dalam mengeksekusi putusan MA.

“Untuk memperhatikan tata cara dan batas waktu pelaksanaan eksekusi putusan pengadilan sesuai dengan ketentuan Pasal 197 KUHAP,” cetusnya.

Desakan Komisi III DPR RI itu menjadi salah satu kesimpulan RDP antara Kejaksaan Agung dan Komisi III DPR RI, yaitu “Komisi III DPR RI mendesak Jaksa Agung RI untuk memperhatikan tata cara dan batas waktu pelaksanaan eksekusi putusan pengadilan sesuai dengan ketentuan Pasal 197 KUHP”.

Menanggapi desakan tersebut, Jaksa Agung Basrief Arief memastikan akan tetap melakukan eksekusi terhadap putusan yang telah berkekuatan hukum tetap (inkracht).

“Kita akan tetap mengekskusi putusan yang berkekuatan hukum tetap. Untuk putusan yang batal demi hukum, akan mematuhi aturan KUHAP,” ungkap Basrief.

Pasal 197 ayat (1) KUHAP huruf k menyatakan, bahwa setiap putusan pemidanaan haruslah memuat, “Perintah supaya terdakwa ditahan atau tetap dalam tahanan atau dibebaskan”.

Jika ketentuan itu tidak dipenuhi, maka menurut Pasal 197 ayat (2) KUHAP mengakibatkan putusan batal demi hukum. Istilah batal demi hukum, dalam teori hukum diartikan sebagai putusan yang sejak semula dianggap tidak pernah ada (never existed) dan tidak mempunyai nilai apa pun secara hukum (legally null and void) sehingga putusan demikian dengan sendirinya tidak dapat dieksekusi. Hari ini ( 14/02/2013 ) ada dua oknum Kejari ( Kejaksaan Negeri Jakarta Selatan ) datang menyusup hendak mengeksekusi paksa Anand Krishna,di Pasraman Anand Ashram Ubud, Bali.

Kalau benar mereka adalah petugas dari Kejaksaan,saya rasa mereka telah melupakan ajaran doktrin Adhyaksa yg terpampang jelas didepan gedung megah di Kejaksaan Agung RI.

Satya Adhi Wicaksana

Ada trikrama Adhyaksa yg semestinya dipegang teguh oleh setiap jaksa dalam menjalankan tugas dan wewenangnya :
1. Satya
Kesetiaan yg bersumber pada rasa jujur baik thdp Tuhan YME,terhadap diri pribadi,dan keluarga,maupun kpd sesama.

2. Adhi
Kesempurnaan dlm bertugas dan berunsur utama pada rasa tanggung-jawab thd Tuhan YME,keluarga,dan sesama.

3. Wicaksana
Bijaksana dalam tutur kata dan tingkah laku,khususnya dlm penerapan kekuasaan dan kewenangannya.

Jika membaca serta mencermati Trikrama Adhyaksa diatas dan lalu dikaitkan dng kasus yg ditimpakan pada Anand Krishna yg penuh dng kejanggalan serta cacat hukum (Untuk lebih jelasnya silahkan kunjungi http://www.freeanandkrishna.com). Maka oknum yg telah melanggar doktrin ini yang mengajarkan tentang kejujuran,rasa tanggung-jawab serta bijaksana dlm bertindak,semestinya mendapat peringatan tegas dan diterapkan disiplin sehingga Institusi Kejaksaan dpt mengemban tugas mulia dng baik.

Sikap Anand Krishna menolak eksekusi adalah sebuah sikap untuk mengembalikan ruh keadilan dan kebenaran yg telah disandera para oknum yg jelas-jelas telah melupakan Trikrama Adhyaksa ini.
Ini adalah perjuangan kemanusiaan utk mengembalikan peranan mulia institusi hukum dlm relnya yg benar.
Sebuah doktrin akan kehilangan makna dan hanya menjadi semboyan omong kosong jika tidak ada ketegasan dlm menindak para oknum yg menyeleweng.

Jalan mencapai kebenaran sejati (satya) adalah jalan yg mulia (adhi). Hanya mereka yg bijaksana (wicaksana),yg telah mampu mengendalikan segala “passion”nya dpt menjalankan tugas yg mulia,besar serta luhur ini.

Since the last few days attempts have been made to arrest the interfaith spiritual activist Anand Krishna: by force. To follow what is going on in Ubud, you can click this streaming video link: http://www.ustream.tv/channel/yudharene

This attempt to arrest Anand Krishna violates Article 197 sub article 2 of the Criminal Code Procedure. The entire case is also full of legal anomalies and there are indications that Anand Krishna’s rights have been deliberately violated.

Yesterday February 13th, 2013 the police had tried to arrest Anand Krishna but failed as the local community refused to collaborate with them.

Today February 14th, 2013 a group of suspicious men have tried to arrest Anand Krishna at his residence in Ubud, Bali, during a symposium with the theme: Realizing Global Peace and Interfaith Harmony through Women’s Love. Several important people were present at the symposium, among them were: Sepcial Staff of RI’s Ministry of Women Empowerment Dr. Pinky Saptandari M.A., Mrs. Ayu Pastika, Gusti Kanjeng Ratu Hemas (DPD-RI), Prof Dr dr LK Suryani SpK, Pangesti Bernardus (Chief Editor of  Women’s Health Indonesia), Ida Ayu Utami Pidada, Maya Safira Muchtar (Initiator of IWAG-Peace), Nadlroh Sariroh (Women Activist), Dr. Sita Thammal Van Bemmelen (BIWA), A.A.A.Ngurah Tini Rusmini Gorda,SH,MM,MH (BKOW-Bali), and an international speaker Ma Anand Bhagawati (from Osho International).

Yudha Rene reported today there were 2 men, who dressed casually (not in military uniform as they should be if they really followed the rules), who were trying to arrest Anand Krishna came without a legal arrest warrant; they didn’t have their ID cards with them. This procedure clearly does not fulfill the established legal rules. Yudha Rene also added, one of the two men claimed that he was “the Attorney number 7” when the local Ubud people asked him to identify himself.  The men threatened that they were going to call up more people to help them. Anand Krishna himself said that he would report this to the police as an attempt to kidnap him.

The former minister of research and science during Gus Dur’s era tweeted: “The attempt to arrest Anand Krishna by force is an abuse and arrogance of power because it’s carried out without proper procedure as regulated by laws.”

Distric attorney should not lie

Prashant Gangtani, the son of Anand Krishna denied the statement of South Jakarta District Attorney Office in which, via a spokesperson, they declared that it is difficult to know his father’s whereabouts. Prashant regretted this vile slander against his father. “We have informed the Legal and Service Centre of the High Attorney Office about my father’s location last year (27/11).  We have a video recording, voice recording, and witnesses related to this matter. So the Chairman of South Jakarta District Attorney Office has obviously lied to public if they say they don’t know where my father is,” Prashant said when we contacted him.

Prashant and Anand’s Lawyers assessed that the Supreme Court’s decision to overturn Anand Krishna’s acquittal is legally flawed since the decision is full of anomalies. It does not even fulfill the elements stipulated by Article 197 (1) sub section d, e, f and h of the Law No.8/1981 about Criminal Code Procedure.

In the decision made by the Supreme Court, there is no legal consideration for the granting of the appeal filed by the Prosecutor Martha Berliana Tobing.  The decision also contains a consideration taken from a criminal case about brand name dispute from the High Court of West Java of 2006 which is in no way related to the case of Anand Krishna.

“All these anomalies convince us that this decision is legally flawed and therefore should be declared null and void for the sake of upholding the law. My father has all the rights to fight against any kinds of illegal attempt to arrest him,” Prashant added.

Several legal experts also agreed that this decision is flawed. Those experts who attended the Public Examination on the Case of Anand Krishna in Yogyakarta (18/10) and Denpasar (25/10) last year are: Prof. Dr. Nyoman Serikat Putrajaya SH MH (Professor of Criminal Law of Diponegoro University), Prof. Dr. Edward Omar Sharif Hiariej SH MHum (Professor of Criminal Law of Gadjah Mada University), Dr. I Dewa Gede Palguna SH MH (Former Constitutional Court Judge 2003-2008), and Dr. IB Surya Jaya SH MH (Criminal Law Expert of Udayana University)

The National Human Rights Commission also voiced their opinion. They think that there are indications of violations against Anand Krishna’s rights in this legal process.

We have also received a copy of the Recommendation of the National Commission on Human Rights. It indicates violations of human rights and errors in the due process of my father. So, the Commission also sent the letter to the Supreme Court, the High Attorney Office and the Police to advise them not to arrest my father because of the violations,” said Prashant.

The Decision of the Supreme Court to overturn Anand’s acquittal was made by the Supreme Court’s Panel of Judges, Ahmad Yamanie, Zaharuddin Utama, and Sofyan Sitompul. Judge Ahmad Yamanie has been dishonorably dismissed by the Judges’ Ethics Council for bribery allegations. Judge Zaharuddin Utama has already been reported to Anti-Corruption Commission and Judicial Commission for bribery allegations in another case. The Supreme Court Judge Sofyan Sitompul was also reported in July last year.

Previously, the Panel of Judges of South Jakarta’s District Court was led by a female judge who is famous for her honesty and integrity, Albertina Ho. She acquitted Anand on November 22nd, 2011.

KPAA Gelar Unjuk Rasa Tolak Kebohongan Publik 2 Oknum Kejari Jaksel

Jakarta, Rabu pagi (13/2/2013), Komunitas Pecinta Anand Ashram (KPAA) kembali menggelar aksi unjuk rasa terkait kebohongan publik yang dilakukan Jaksa Agung Muda Bidang Pidana (Jampidum) Mahfud Manan dan Kepala Kejaksaan Negeri Jakarta Selatan (Kejari) Masyhudi.

 

Duet oknum penegak hukum tersebut menyampaikan pernyataan fiktif di pelbagai media massa ihwal keberadaan Anand Krishna yang sering berpindah-pindah tempat.

 

KPAA menyampaikan aspirasinya langsung ke Kejagung, yakni menuntut kelalaian kedua oknum tersebut ditindak tegas Jaksa Agung. Bukankah sangat menyedihkan bila pejabat yang diamanahi rakyat justru menjadi pembohong publik?

Juru bicara KPAA sekaligus putra Anand, Prashant Gangtani mengatakan bahwa sejak jauh hari KPAA telah memberitahu keberadaan Anand ke Pusat Pelayanan dan Hukum Kejagung pada 27/11/2012. Hal tersebut dilakukan di depan khalayak ramai dan ada rekamannya pula.

 

Bahkan, keberadaan Anand di Bali telah diketahui oleh pihak media massa dan pejabat setempat. Jadi bohong jika Anand Krishna berpindah-pindah lokasi menghindari eksekusi. “Banyak tokoh Bali, tokoh nasional, bahkan pejabat dari Komnas HAM dan PBB telah mengunjungi Pak Anand di Ubud. Adalah sebuah kebohongan publik bila kejaksaan mengaku tidak mengetahui keberadaannya!” tandas Prashant.

 

Lebih lanjut, Prashant mengatakan bahwa ayahnya tidak pernah menghindari eksekusi, tapi menolak eksekusi. Sebab putusan MA itu cacat hukum, melanggar undang-undang negara serta hak asasi manusia, kesetaraan dan akan melawan eksekusi yang tidak sesuai dengan aturan ketentuan hukum yang berlaku hingga titik darah terakhir.

Dari aspek yuridis, kuasa hukum Anand berpendapat bahwa putusan MA tidak memenuhi syarat pemidanaan seperti yang tercantum di Pasal 197 ayat 1 butir d, f, h dan l Kitab Undang-Undang Hukum Acara Pidana (KUHAP), dan dipenuhi oleh berbagai kejanggalan dan tanpa logika hukum. Antara lain pemutarbalikan fakta dan kebohongan yang dilakukan oleh JPU Martha Paruliana Berliana.

 

“Misalnya, dengan merubah identitas seorang saksi ahli, memasukkan kasus Erik Mulya Kusuma di Jawa Barat sebagai pertimbangan hukum, dan mengabaikan berbagai fakta dalam proses persidangan, termasuk kebohongan tentang tanggal, ancaman pembunuhan oleh Muhammad Djumaat Abrory Djabbar kepada ayah saya, dan banyak hal yang lain,” imbuhnya.

 

Sebelumnya, Majelis Hakim Pengadilan Negeri Jakarta Selatan yang dipimpin oleh Hakim Perempuan jujur dan berintegritas Albertina Ho telah memvonis bebas Anand tanggal 22 November 2011.

Denpasar (ANTARA News) – Tokoh spiritual Anand Krishna membantah tuduhan Kejaksaan Agung yang menyatakan dia melarikan diri terkait perkara asusila, sebagaimana kasasi Mahkamah Agung.

“Saya tidak melarikan diri seperti dituduhkan Kejaksaan Agung di Jakarta selama ini. Sejak ada keputusan kasasi Mahkamah Agung yang cacat hukum itu, saya sudah berada dan bermukim di Bali. Saya tidak ke mana-mana,” kata Krishna di Ubud, Kabupaten Gianyar, Bali, Rabu.

Menurut dia, keberadaannya di Bali diketahui semua pejabat, termasuk Jaksa Agung karena dia pernah berkirim surat kepada mereka.

“Ini sungguh tidak masuk akal aparat kejaksaan tidak mengetahui keberadaan saya selama ini. Saya katakan sejak dua tahun lalu saya tetap di Bali, bahkan di ashram (padepokan) Ubud ini,” katanya menegaskan.

Selama di Bali, dia menulis buku dan mengikuti kegiatan-kegiatan sosial yang dihadiri oleh pejabat daerah dan tokoh masyarakat.

“Itu juga dibuktikan dengan penandatangan prasasti yang terpampang di Ashram Anand Khrisna oleh pejabat negara maupun pejabat negara-negara sahabat, seperti India,” ucapnya.

INILAH.COM, Gianyar – Tokoh spiritual lintas agama Anand Krishna menuding oknum Kejagung melakukan kebohongan publik, membunuh karakternya bahkan lebih dari itu melakukan fitnah dengan mengatakan dirinya buron.

Anand mengaku, sejak putusan kasasi Mahkamah Agung, ia tidak pergi ke mana-mana melainkan lebih banyak diam di padepokannya di Ubud. Ia bahkan mengaku selama ini dipadepokannya dirinya melakukan meditasi, menulis buku dan berdoa.

“Keberadaan saya di Ubud, diketahui banyak orang termasuk para pejabat. Jadi oknum kejaksaan telah memutarbalikkan fakta memfitnah dengan mengatakan saya buronan sering berpindah-pindah tempat,” kata Anand didampingi pimpinan Anand Asram Ubud Wayan Sayoga kepada wartawan, Rabu (13/2/2013).

Anand merasa, penetapan status buronan itu telah mengganggu piskologisnya yang ikut terpukul. Secara psikis dan fisik, Anand mengaku dirinya terpukul jika ada dokter yang memeriksanya sekarang akan menemukan betapa terpukulnya kondisi kejiwaannya. “Mereka harus bayar ini semua. Mereka telah merampas kemerdekaan saya yang diberikan Gusti Allah,” tegasnya.

Anand menilai, oknum kejaksaan atas nama konstitusi dituding telah cuci tangan dan berusaha membenturkan dirinya dengan rakyat. Untuk itu, Anand, tidak akan membiarkan kesewenang-wenangan aparat yang telah merampas hak-haknya sebagai warga negara yang bermartabat.

“Saya akan tetap melawan sampai jiwa raga atas kesewenang-wenangan oknum aparat. Kalau saya menerima putusan ini berarti sama saja membiarkan kesewenangan terjadi. Akan banyak rakyat dianandkrishanakan, padahal mereka tak bersalah sehingga bisa mengalami nasib seperti saya,” jelasnya.

Menanggapi rencana penjemputan paksa oleh jaksa di padepokan Anand Asram di Tegalantang, Ubud, Kabupaten Gianyar, Bali, Anand menilai kejaksaan tidak punnya dasar hukum kuat untuk mengeksekusi dirinya sehingga jika dipaksakan maka hal itu sama saja dengan tindak pidana penculikan.

Keputusan kasasi Mahkmah Agung juga dianggap Anand cacat hukum dan banyak kejanggalan karena diputuskan oleh majelis hakim yang diragukan kredibilitasnya dan mengabaikan fakta-fakta yang terungkap di persidangan.

“Putusan itu cacat hukum dan banyak kejanggalan sehingga eksekusi tidak bisa dilaksanakan,” bebernya.

Anand akan menjelaskan kepada publik bahwa dirinya telah diculik jika putusan dipaksa untuk dilaksanakan dengan mengeksekuinya. Atas ketidakadilan dan perilaku kotor oknum penegak hukum yang diterimanya, Anand mengaku sudah dua kali melaporkan kasus yang dialaminya ke Presiden Susilo Bambang Yudhoyono namun hingga kini belum ada tanggapan.

Seorang presiden, menurut Anand harusnya SBY memperhatikan atas apa yang telah menimpa warga negara yang dirampas hak dan martabatnya oleh oknum penegak hukum dan praktek kotor peradilan. “Saya berharap Pak SBY bisa membuktikan sikap kenegarawanannya, melindungi martabat dan hak seorang warga negara,” tandasnya.[bay]Image
